OBJECTIVES
- Understand the administrative life of a crew and know how to use the tools provided by the authorities
- Understand what a fitting-out permit is, what it entails and the specific features of a vessel fitted out in the RIF.
- Be able to find the applicable legal references, understand the distinction between resident and non-resident and its implications in terms of employment law.
- Understand the rules governing affiliation to a social security scheme depending on the seafarer’s place of residence, know how to distinguish between Enim and Urssaf charges and how they are calculated.

PROGRAMME
I. Seafarers’ block
Content :
– Distinctions between seafarers and non-seafarers and between seafarers and non-seafarers;
– Procedure for identifying seafarers;
– Training and issue of certificates;
– Visas and derogations;
– Digital space for seafarers ;
– Promété.
Objective: understand the administrative life of a crew and know how to use the tools made available by the authorities.

II. Weaponry block
Content:
– The different types of fitting-out permit;
– Minimum crew complement form;
– The shipowner’s portal;
– Crew composition criteria in the RIF ;
– Specificities relating to captains and their deputies.
Objective: to understand what a shipowner’s permit is, what it entails and the specific features of a vessel operating under the RIF.

III. Labour law block
Content:
– General legal framework: Book V vs Book VI of the Transport Code
– Collective labour relations and collective agreements ;
– Individual labour relations :
- CEM
-> for seafarers resident in France;
-> of seafarers residing outside France; - Use of an ETM:
->Definition of an ETM and the need for a direct link between ETM and shipping company
-> Specific features of French ETMs;
-> Specificities of using a foreign ETM. - Management of working hours and overtime:
-> For seafarers resident in France;-> For seafarers not resident in France;
-> Specific features of the yachting sector. - Rest and holidays :
-> For seafarers resident in France;
-> For seafarers not resident in France.
– Professional disputes:
-> Resolving professional disputes: conciliation, a specific maritime feature;
-> Complaints and claims by seafarers.

IV. Employment law block
Content:
– Affiliation depending on place of residence:
-> Social security for employees residing in the EU/EEA/Switzerland/United Kingdom
-> Social security for employees residing outside the EU/EEA/Switzerland/UK;
– Focus on Enim :
-> Benefits ;
-> Category classification;
-> Calculation method and costs.
– Focus on Urssaf: contributions and calculation methods;
– The Nominative Social Declaration;
– The Enim marine area.
Objective: To understand the rules governing affiliation to a social security scheme depending on the seafarer’s place of residence, to know how to distinguish between Enim and Urssaf charges and how they are calculated.
